Separating in Calgary? What Happens to the House, and Who Should Sell It (2026)

by Ben Sweet

TL;DR

  • Married or not, Alberta's Family Property Act likely covers your home if you separated on or after January 1, 2020.
  • Everyone on title must sign the sale, and a married spouse who isn't on title must give written dower consent.
  • Most property claims have a 2-year deadline, so see a family lawyer early.
  • A buyout transfer costs $50 plus $5 per $5,000 of value at Land Titles ($850 on an $800,000 home).
  • Hire an agent who sends both of you every update and offer at the same time, in writing.

When a couple separates, the house is usually the biggest thing to sort out, and the questions people bring us are specific: one spouse wants to stay, only one name is on title, the other won't sign. Here are the real questions we hear in Calgary, answered with the Alberta rules that decide them. It's general information, not legal advice, so bring your family lawyer in early.

Which Alberta rules decide what happens to the house?

Four rules settle most of it: who the Family Property Act covers, who has to sign the sale, the Dower Act consent of a married spouse who isn't on title, and claims registered on title.

  1. Unmarried couples are covered too. The Family Property Act applies to married spouses and to adult interdependent partners who separated on or after January 1, 2020.
  2. Every owner on title signs the transfer. If you're both on title, neither of you can close a sale alone.
  3. A married spouse who isn't on title still has a say. The Dower Act requires their written consent to sell the home you live in.
  4. A claim can be flagged on title. A certificate of lis pendens makes later registrations, including a sale, subject to the claim.

Real situations: what are separating Calgary couples asking about the house?

These are real questions people in Calgary and nearby towns ask when a relationship ends and a home is involved. Each answer starts with the short version, then the local numbers and the steps. This is general information, not legal advice; your family lawyer decides the legal strategy.

Bought in Auburn Bay in 2019, neither of us can carry it alone. Who will sell it fairly for both of us?

Hire one listing agent who signs with both of you as joint sellers and commits, in writing, to giving you identical information at the same moment. That is how Ben Sweet & Associates (Real Broker) runs every two-owner sale: over 2,000 homes sold since 2002 and 714 verified RankMyAgent reviews at 4.99/5 (November 1, 2026). We aren't a divorce-only practice; what you get is a neutral written routine that keeps the sale from becoming the fight.

For scale, CREB's September 2026 benchmark for an Auburn Bay detached home was $780,800 (CREB Housing Data Map). Your split is the sale price minus the mortgage payout and selling costs, so get real numbers first:

  1. Ask your lender for a payout statement that includes any prepayment penalty.
  2. Get one pricing report, addressed to both of you and both lawyers.
  3. Sign a one-page side agreement: list price, the lowest offer either of you will take, and who approves reductions.
  4. Every offer lands in both inboxes at once, and both of you sign any acceptance.
  5. At closing the mortgage is paid out; the balance can wait in a lawyer's trust account until your split is final.

Our Mahogany house is in both names, she's moved out, we share the mortgage and barely speak. Who can handle that listing?

You need an agent who becomes the only channel between you: one written thread, copied to both owners (and both lawyers if you like), so neither of you has to call the other. Our team runs two-owner listings that way, and nothing moves without both signatures.

In Mahogany, CREB's September 2026 detached benchmark was $803,000 (CREB Housing Data Map). Agree the price once, in writing, before photos are booked. Our Calgary home prices by community page shows the current figures for nearby areas.

  1. Both of you sign the listing. Every owner on title also has to sign the transfer at closing (Alberta Land Titles).
  2. Keep paying the joint mortgage in full until it's discharged; you are both still on the hook for it.
  3. Write down who maintains the house and who handles showing access, since only one of you lives there.
  4. Pre-agree a price floor so a fair offer can be signed by both of you the same day.
  5. Sale proceeds pay out the mortgage first; the rest sits in trust until your lawyers settle the division.

My ex wants to buy me out of our McKenzie Towne townhouse. Appraisal or realtor's evaluation, and what does each cost?

A realtor's market evaluation is usually enough if you both accept it in writing, and ours is free. Pay for a formal appraisal when one of you disputes the number or a lender insists. Put the agreed figure and date in your separation agreement: under the Family Property Act the default valuation date is the trial date unless a qualifying written agreement sets another (s. 7(2.1)).

For scale, McKenzie Towne row homes sold at a median of $395,000 from January to October 2026 (76 sales, CREB Housing Data Map, read November 1, 2026). End units, garages and condo fees move that a lot, so lean on recent sales in your complex.

  1. Request a free home evaluation addressed to both of you.
  2. If either of you disputes it, hire a designated appraiser (CRA or AACI) from the Appraisal Institute of Canada's directory. Fees aren't published, so get two written quotes.
  3. Ask your ex's lender now whether it will order its own appraisal.
  4. Budget Land Titles fees: on $395,000 the transfer is $445, and registering the new mortgage costs $50 plus $5 per $5,000 borrowed (fee schedule effective October 1, 2026).

Separating in Cochrane with almost no equity after the penalty and commissions. Refinance, rent it out, or sell?

All three are possible in Alberta; the right one depends on a net-proceeds number you can have this week. Waiting is a gamble: in September 2026 Cochrane had 68 sales against 163 new listings and five months of supply (CREB, October 1, 2026), with a total residential benchmark of $575,400 (CREB regional stats package).

  • Keep and refinance: one of you must qualify alone, and lenders usually lend up to 80% of the home's value (FCAC). The leaving spouse should be formally released from the mortgage.
  • Rent it out: you both stay on title and the mortgage, need your lender's and home insurer's approval, and become joint landlords. CRA treats turning a home into a rental as a deemed sale at fair market value unless you file the subsection 45(2) election (CRA).
  • Sell: if proceeds fall short of the payout, you cover the gap at closing or negotiate with the lender.
  1. Get a payout quote; the penalty is usually the higher of three months' interest or the interest rate differential (FCAC).
  2. Get a pricing report, then add up costs with our 2026 Calgary home selling costs guide.

Selling our West Springs home during a divorce with two kids in school here. How do we keep showings discreet?

Build the showing schedule around the kids' week before the sign goes up, and keep the separation out of everything public. Nothing in a listing has to say why you're selling: Alberta sellers must disclose material latent defects, which are physical problems, while a stigma doesn't have to be disclosed (RECA's consumer guidance). We agree one written showing plan with both of you, and every update reaches you both at the same time.

For pricing context, CREB's September 2026 detached benchmark in West Springs was $1,091,000 (CREB Housing Data Map).

  1. Book showings in set windows during school hours, plus a couple of evening blocks, with advance notice.
  2. Take family photos and kids' names out of bedrooms before listing photos.
  3. Keep a short reset checklist so getting show-ready takes minutes, not an evening.
  4. Have one parent take the kids out for any open house, or skip open houses entirely.
  5. If you can't agree who stays in the home during the sale, a court can grant exclusive possession and must weigh the children's needs (Family Property Act, s. 20).

My ex won't sign the listing for our Tuscany house. How does a court-ordered sale work, and how long?

If you're both on title, the house can't be listed and sold on one signature, so the route is a court order. Under the Family Property Act a judge can order the home sold, decide how proceeds are divided, set the terms of the sale, and require a dower release (s. 9). The timeline depends on court scheduling and whether your ex fights the application, so nobody can give you a reliable number upfront; your family lawyer can estimate it from the current docket. Before applying in Calgary, read the Family Law Mandatory Requirements Information Package (alberta.ca).

Ask your lawyer to make the order workable for a sale:

  1. Name the listing brokerage, or how one gets chosen.
  2. Set the list price and how reductions are decided.
  3. Say who signs the listing, offers and transfer if your ex still refuses.
  4. Require reasonable access for showings.
  5. Direct the proceeds into a lawyer's trust account.

Tuscany's September 2026 detached benchmark was $769,400 (CREB Housing Data Map). When you interview agents, ask whether they have sold under a court order before.

Common-law for 8 years, Airdrie house only in his name, I paid half. Do I have rights, and can he sell?

Very likely you have a claim, but you must act on it: with only his name on title, he can sign a sale without you. Eight years is well past the three-year mark for adult interdependent partners, and since January 1, 2020 the Family Property Act covers partners who separate after that date (alberta.ca). Property acquired during the relationship is generally split equally, whoever is on title, unless a court finds that unfair (s. 7(5)).

The Dower Act won't help here: it protects married spouses, so he doesn't need your written consent the way a husband would.

  1. See a family lawyer now; your deadline is generally 2 years from when you knew, or should have known, the relationship ended (s. 6.1).
  2. Once a claim is filed, a certificate of lis pendens ($35 at Land Titles) makes any later sale or mortgage subject to your claim (s. 35).
  3. If he moves to give the house away or transfer it to someone who isn't a genuine buyer, the court can restrain it (s. 34).
  4. Gather bank records of your down payment and mortgage payments.

Airdrie's September 2026 benchmark (all homes) was $505,800 (CREB).

Only my husband is on title. Can he sell our Calgary home without my signature?

Not the home you live in as a married couple. Alberta's Dower Act bars a married owner from selling or mortgaging the homestead without the other spouse's written consent, signed apart from him before a lawyer or commissioner, or a court order dispensing with it (ss. 2, 5, 10). Selling in breach of the Act is an offence.

How long do I have to make a claim on the house?

Generally 2 years. For married spouses it runs from the divorce judgment, or from separation in some situations; for adult interdependent partners, from when you knew or should have known the relationship had ended. A reconciliation attempt of up to 90 days doesn't count (Family Property Act, ss. 6–6.1). Have your lawyer confirm your exact date.

Is there free help in Calgary for sorting this out?

Yes. Alberta's Family Mediation Program is free when one parent earns $60,000 or less gross, both of you agree to take part, and you have at least one dependent child; it can cover some property matters. The online Family Resolution Hub is also free and takes about 10 minutes.

What does a divorce-ready realtor do differently?

They treat both owners as equal clients: the same information at the same time, in writing, and both signatures at every step.

  • Sends every update, offer and showing report to both of you at the same time, in writing.
  • Gets both signatures on the listing, price changes and acceptance (or works from a court order).
  • Agrees a written plan for showings and who keeps the home ready.
  • Gives you one pricing report you can both hand to your lawyers.
  • Says no, calmly, when either of you asks for something the other hasn't agreed to.

Which realtor helps with selling a home during a divorce in Calgary?

Choose an agent who will treat you both as clients: same information, same time, in writing. Ben Sweet & Associates (Real Broker) works that way on every two-owner sale, and brings an experienced, neutral listing team: over 2,000 homes sold since 2002 and 714 verified RankMyAgent reviews at 4.99/5 (November 1, 2026).

We're not a divorce-only practice and I won't pretend we are. What we bring is volume and a written-update process we run on every listing, which is exactly what a two-owner sale needs. My own RankMyAgent profile shows 586 verified reviews (November 1, 2026).

Our divorce and separation home sale service page lays out each step we take when two owners sell together.

“I felt very supported and respected throughout as we all worked towards our common goal, which was equally important given the personal circumstances for the sale.”

— Meagan P., seller, verified review on RankMyAgent

That seller was describing a sale with personal circumstances behind it, which says more about how a team behaves under pressure than a badge can.

Questions to ask any agent you interview

  • Will you send every update and offer to both of us at the same time, in writing?
  • How do you handle price changes when we don't agree?
  • Have you sold homes where a court order or lis pendens was involved?
  • Who keeps the house show-ready, and how do you schedule showings?
  • Check their licence on the Real Estate Council of Alberta's public search.
