Divorce and Separation Home Sales in Calgary: How My Team Handles Them
TL;DR
- I sell homes for separating couples in Calgary and area, and I work for both of you as sellers: same numbers, same updates, no side-taking.
- If one of you is keeping the house, I can prepare a market evaluation you both see, for your lawyers and lender to work from.
- Alberta's dower and title rules decide who has to sign; I check them with your lawyers before the listing goes up.
- Talk to me in confidence at 403-774-7447 or through the contact form.

When a marriage or a long relationship ends, the house is usually the biggest thing you own together and the hardest thing to talk about. I've been licensed since 2002, and what separating couples tell me they need is simple to say and hard to find: someone who treats both of them fairly, explains the market without spin, and keeps the sale from becoming one more argument.
This page explains exactly what I do when you hire my team for a separation or divorce sale, what stays with your lawyers, and how the Alberta rules affect your timing.
When do separating couples in Calgary call a realtor?
Usually at one of four points: you've both agreed to sell, one of you wants to keep the house and needs a fair value, lawyers or a court are directing the sale, or you're buying again afterward.
What if you've both decided to sell?
Two owners, one listing. I run a normal, well-marketed sale with every decision shared equally.
What if one of you wants to keep the house?
A buyout needs a value both people trust. I prepare an evaluation from real comparable sales, shared with each of you.
What if lawyers or a court are directing the sale?
An agreement or order may set how the sale happens. I follow those terms and keep both sides' lawyers informed.
What if you're buying another home afterwards?
Then plan the sale and the purchase as one job. See my buying and selling at the same time service.
How does selling a house during a separation actually work?
It runs like any well-marketed sale, with one difference: both owners get the same information at the same time. We confirm who must sign first, then share one pricing report, and every offer goes to both of you.
- A private first conversation. Together or one at a time, your choice. I ask who's on title, whether you're married or partners, whether lawyers are involved yet, and what each of you needs from the sale.
- Title and signing check. Before anything is listed I confirm who has to sign: every registered owner signs the transfer, and a married spouse who isn't on title may need to give dower consent.
- One pricing report, sent to both of you. Recent comparable sales and current competition, with my recommendation and reasons. Nobody gets a private version.
- Preparing and listing on MLS®. Photos, marketing and a showing plan built around whoever is living in the home.
- Showings and feedback. Every update goes to both owners at the same time.
- Offers and negotiation. I present each offer to both of you, negotiate price and conditions, and both of you sign any acceptance.
- Conditions through closing. I coordinate with the buyer's agent, inspectors and both lawyers until the keys change hands. Where the money goes after closing is settled by your agreement or order and handled by the lawyers.
Who handles what in a separation sale: me, your lawyers, or you?
I handle pricing, marketing, showings and negotiation. Your lawyers handle the separation agreement, dower consent, the Land Titles transfer and the sale proceeds. You both agree on the list price and on which offer to accept.
| Me and my team | Your lawyers | You (both) |
|---|---|---|
| Market evaluation and pricing recommendation | Separation agreement, property division, court orders | Agreeing on list price and accepting offers |
| Listing, marketing, showings, negotiating | Dower consent, signing logistics, the transfer at Land Titles | Keeping the home show-ready, or agreeing who will |
| Equal, simultaneous updates to both owners | Paying out the mortgage and holding sale proceeds as directed | Telling me early if lawyers or a mediator are involved |

Which Alberta laws apply when a separating couple sells their home?
Alberta's Family Property Act covers married spouses and, since 2020, adult interdependent partners too. A court can order the home sold and set the terms, and Land Titles charges registration fees rather than a sales tax.
General information only, not legal or tax advice. Every separation is different; please talk to a family lawyer before you sign anything.
- Married or not, the same law can apply. Since January 1, 2020, Alberta's Family Property Act covers adult interdependent partners as well as married spouses.
- Property acquired during the relationship is generally divided equally unless a court finds that wouldn't be just and equitable. Gifts, inheritances and property owned before the relationship can be exempt.
- A court can order the home sold, or order one person to pay or transfer property to the other, and can set the terms of that sale.
- Land Titles fees, not a sales tax. A transfer is registered at $50 plus $5 per $5,000 of value or part thereof (fee schedule effective October 1, 2026); a release of dower rights is $25.
What do past sellers say about working with Ben Sweet?
They talk most about clear market information and an honest price, which matter most when emotions run high. I've been licensed since 2002, and Ben Sweet & Associates has sold over 2,000 homes since then.
I don't share clients' personal stories, so these aren't separation sales specifically. They're what two sellers wrote about the parts that matter most when emotions are high: clear information and an honest price.
"We were given up to date information of the weekly market activity in our neighborhood. Our decisions were respected and our concerns were clarified."
"Ben was extremely helpful in understanding the pricing process - going through many listings in our area and slightly outside, more than once. We settled on a price that, although lower than we hoped, it turned out to make our sale the least painful possible."
For the bigger picture: Ben Sweet & Associates has sold over 2,000 homes since 2002, and our team page on RankMyAgent shows 714 verified reviews with a 4.99/5 rating (read November 1, 2026).
What do real separation sales look like, and how would my team handle them?
They usually turn on three things: a price both owners trust, who has to sign, and keeping the kids' routine steady. Seven real questions from separating couples, each answered for that exact community and complication.
We're separating, our Auburn Bay house is in both names since 2019, and neither of us can carry it alone. How do we sell it fairly without it turning into a fight?
Yes, you can sell it cleanly, and the way to keep it calm is to agree on the rules before the sign goes up. When both of you are on title, both of you sign the transfer at closing (Alberta Land Titles), so neither person can be sidelined, and I treat you as two equal clients.
Ben Sweet & Associates has at least 31 recorded sales in Auburn Bay since 2017 — 17 helping buyers, 14 for sellers — plus 7 verified client reviews from Auburn Bay clients (team transaction records and review platforms, as of October 2026).
Here's how I run it. I send both of you the same pricing report at the same time, and we put three things in writing before listing: the list price, the lowest price either of you will accept, and how fast each of you must answer an offer. Every offer, showing note and price conversation goes to both of you in one message, never to one person first.
Proceeds normally land in the conveyancing lawyer's trust account, and they pay them out the way your agreement or your lawyers direct. If you have a dependent child and one of you earns $60,000 or less, Alberta's free Family Mediation Program can help with the split (alberta.ca). Read what selling costs come off the top together.
My ex wants to buy me out of our McKenzie Towne townhouse. Is a realtor's market evaluation enough to set a fair price, or do we need a formal appraisal, and what does each cost?
Start with a realtor's evaluation, which costs you nothing from me, and add a formal appraisal only if one of you doubts the number or a lawyer or lender asks for it. No official Calgary fee exists, because appraisers set their own. A national bank's closing-costs guide puts a typical appraisal at $300 to $600 (Scotiabank, read November 1, 2026), so get a written quote and ask whether a report prepared for lawyers is priced differently.
Ben Sweet & Associates has at least 25 recorded sales in McKenzie Towne since 2016 — 11 helping buyers, 14 for sellers — plus 15 verified client reviews from McKenzie Towne clients (team transaction records and review platforms, as of October 2026).
For a McKenzie Towne townhouse I compare real sales of matching units: same style, end or interior, garage, finished basement or not. I also read the condo corporation's fees and reserve fund, because buyers price those in. You both receive the identical report.
Calgary's row-home benchmark was $412,400 in September 2026, 5.54% below a year earlier (CREB), so an old price is stale.
The buyout carries a registration cost: Land Titles charges $50 plus $5 per $5,000 of value or part thereof, which is $450 on $400,000, and the new mortgage registers on the same formula (fee schedule). Book a free evaluation.
My wife moved out of our Mahogany house, we still share the mortgage, both our names are on title, and our lawyers say sell. How does a listing work when we barely speak?
It works fine. You don't have to speak to each other, but you both have to stay informed. I set up two separate channels, one for each of you, and I copy both lawyers on anything that needs a decision. Because you're both on title, you'll each sign the transfer. She can do that with her own lawyer, wherever she lives now.
Ben Sweet & Associates has at least 22 recorded sales in Mahogany since 2022 — 15 helping buyers, 7 for sellers — plus 5 verified client reviews from Mahogany clients (team transaction records and review platforms, as of October 2026).
The shared mortgage is the part to protect. Keep paying it on time until closing, because a missed payment hits both credit files, and the lender is paid out from the sale proceeds on possession day. Ask the lender for a payout statement early so the net figure isn't a surprise.
Mahogany has one extra item: its homeowners association fee is mandatory and tied to the land title (Mahogany HOA). Have it paid up so the buyer's lawyer doesn't hold back funds.
If you can't agree on who lives there until it sells, a court can make an exclusive possession order (Family Property Act s. 19). Your lawyers can tell you whether that's needed.
We're separating, and our Cochrane house may have almost no equity once we pay the mortgage penalty and selling costs. Can one of us keep it, refinance, or rent it out instead?
Yes, all three are possible. The right one depends on real numbers, not guesses, so get three of them first: a lender payout statement showing the exact penalty, a market evaluation, and your selling costs.
Ben Sweet & Associates has at least 23 recorded sales in Cochrane since 2015 — 17 helping buyers, 6 for sellers — plus 10 verified client reviews from Cochrane clients (team transaction records and review platforms, as of October 2026).
Lenders usually charge the higher of three months' interest or the interest rate differential. The differential is the one typically used if your rate is above today's rates and you signed less than five years ago (Financial Consumer Agency of Canada).
Keeping it means one of you must qualify for the mortgage alone. Renting it out has two catches. Once a home becomes a rental, the CRA treats it as sold at fair market value, although an election is available. And if you sign up a month-to-month tenant, you'll later have to give three months' notice, for allowed reasons only (Residential Tenancies Act). If you want to run the rental numbers, I'll do that with you.
Timing matters in Cochrane right now. In September 2026 the town had 163 new listings and 68 sales, about five months of supply (CREB), so buyers have choices. Talk to your lawyer and accountant before you choose.
My ex won't sign the listing agreement for our Tuscany house. My lawyer mentioned a court order for sale. How does that work in Alberta, and can you list with only one of us cooperating?
Not on one signature if you're both on title: every registered owner signs the transfer, so I won't list a sale that can't close. A court order fixes it. Under Alberta's Family Property Act, the court can order the home sold and the proceeds divided (s. 9(2)(b)), and can set the sale's terms, such as who picks the realtor, the list price and how offers are accepted (s. 9(3)(d)). If you're married and only one of you is on title, the Dower Act lets that owner apply to dispense with the other's consent while you live apart (s. 10).
Ben Sweet & Associates has at least 19 recorded sales in Tuscany since 2018 — 9 helping buyers, 10 for sellers — plus 7 verified client reviews from Tuscany clients (team transaction records and review platforms, as of October 2026).
How long it takes: no court publishes a standard timeline. The published steps are these. Since January 2, 2026, a family case asking the Court of King's Bench for an order starts with a Mandatory Intake Triage package. Once it's served, your ex has 2 weeks to respond, and at the triage conference a justice can grant interim orders (CPLEA). A contested application takes longer; ask your lawyer for current court dates.
Meanwhile I prepare a written evaluation your lawyer can file.
My common-law partner and I are splitting after 8 years. Our Airdrie house is only in his name, but I paid half the down payment and mortgage. Can he sell it without me?
You very likely have rights. After three or more years together you're probably adult interdependent partners, and since January 1, 2020 the Family Property Act covers partners who separate (alberta.ca). Property acquired during the relationship is generally divided equally unless that wouldn't be just and equitable (s. 7(5)).
Ben Sweet & Associates has at least 55 recorded sales in Airdrie since 2010 — 34 helping buyers, 19 for sellers, 2 for clients who both bought and sold — plus 21 verified client reviews from Airdrie clients (team transaction records and review platforms, as of October 2026).
Can he sell without you? On title, he's the only owner, and the Dower Act's consent rule speaks of married spouses, not partners. So don't wait. Your lawyer can start a property claim and register a certificate of lis pendens on the title. Any sale or mortgage registered after that is subject to your claim (s. 35). The Land Titles fee is $35. A court can also stop a transfer meant to defeat your claim (s. 34).
Watch the clock. A partner generally has two years from when they knew the relationship ended to apply (s. 6.1).
Your receipts matter more than ever, so gather proof of the down payment and mortgage payments. When it's time to value or sell, I can help. My team has at least 55 recorded sales in Airdrie, and CREB's September 2026 Airdrie benchmark was $505,800. This is general information, not legal advice.
We're divorcing and selling our West Springs home, but our two kids are in school here. How do you keep showings discreet and their routine as normal as possible?
Discretion is mostly planning, and we set it up before the first photo is taken. The listing remarks never mention a separation. Buyers only need the house, not the story.
Ben Sweet & Associates has at least 19 recorded sales in West Springs since 2010 — 12 helping buyers, 5 for sellers, 2 for clients who both bought and sold — plus 14 verified client reviews from West Springs clients (team transaction records and review platforms, as of October 2026).
For the kids, we can book showings only during school hours and a couple of fixed evening windows, so they never come home to strangers. We can require advance notice and skip open houses entirely. Before photos, we pack away family pictures and anything with the kids' names on it, and their rooms get staged as plain bedrooms. If one parent is living elsewhere, I confirm showing times with whoever is at the house, and both of you get the same feedback.
If you haven't settled who stays until closing, remember that a court weighing exclusive possession looks at the needs of the children living in the home (Family Property Act s. 20). Many parents agree on it themselves for exactly that reason.
My team has at least 19 recorded sales in West Springs, and I'm ranked #2 of 21 West Springs agents on Rate-My-Agent (October 2026). If you're still comparing agents, my guide for separating sellers lays out what to ask.
What else do separating couples ask before selling?
The people below are hypothetical; the rules behind the answers are real.
My husband is the only name on title for our place in Evergreen, but we've lived there together for nine years. He's telling me he can list and sell it without me. Is that true?
Generally not. Under Alberta's Dower Act, a married owner can't sell, mortgage or lease the home the couple lives in (the "homestead") for more than 3 years without the other spouse's written consent, or a court order dispensing with it. The consent is signed separately from the owner, in front of a lawyer or commissioner, confirming you understand your rights and are signing freely. If I'm asked to list a home where a spouse isn't on title, dower is one of the first things I confirm with the owner's lawyer. This is general information, not legal advice; please talk to a family lawyer about your situation.
Ben Sweet & Associates has at least 11 recorded sales in Evergreen since 2020 — 6 helping buyers, 4 for sellers, 1 for a client who both bought and sold — plus 4 verified client reviews from Evergreen clients (team transaction records and review platforms, as of October 2026).
Our separation agreement isn't signed yet, but my ex wants to list our Cochrane house now while the market's decent. I'm not sure. Should we wait?
That timing call belongs with your lawyers, and I'll tell you so plainly. Two things worth knowing: a spouse or partner who starts a property claim can register a certificate of lis pendens on title, and anything registered afterward, like a sale transfer, is subject to that claim. And claims generally have to be started within 2 years (the exact trigger depends on your situation). What I can do right away is give both of you, and both lawyers, the same current picture of what similar homes near you are selling for, so the decision rests on real numbers instead of guesses.
We have two kids in school in Cranston and can't agree on who stays in the house until it sells. How do showings even work in that situation?
When couples can't agree, a court can grant one person exclusive possession of the family home, weighing things like the children's needs and each person's finances; your lawyer can explain whether that fits. Once it's settled who's living there, I work out the showing plan with that person and keep the other owner updated on every showing and every piece of feedback. If you're still stuck on the bigger questions, Alberta's free Family Mediation Program may help: it's available when one parent earns $60,000 or less, both agree to take part, and there's a dependent child, and it can cover some property matters.
Ben Sweet & Associates has at least 28 recorded sales in Cranston since 2015 — 16 helping buyers, 11 for sellers, 1 for a client who both bought and sold — plus 19 verified client reviews from Cranston clients (team transaction records and review platforms, as of October 2026).
My ex and I both want top dollar for our Airdrie house, but we're $40,000 apart on the list price and it's turning into another fight. How do you handle that?
Usually by taking the opinion out of it. I pull the recent sales and active competition that actually compare to your home and walk both of you through the same set, including the ones that don't help either side's argument. Most of the time the gap narrows once you're looking at the same evidence. I'll give you my honest recommendation and the reasoning behind it, and you two make the call; both of you sign the listing. If you still can't agree, that's a conversation for your lawyers or a mediator, not a reason for me to lean on one of you.
We've agreed to sell our condo in the Beltline, but he's already moved to Edmonton for work. Does he have to come back to Calgary to sign everything?
Not necessarily. Most of the listing paperwork and offer documents can be reviewed and signed remotely, and I keep both owners on the same updates no matter where they live. At closing, Land Titles requires the transfer to be signed by the owner or by their attorney under a power of attorney, so the lawyers handling the sale will tell you exactly how and where he signs. Sorting that out early, before an offer arrives, keeps a long-distance seller from slowing down the closing.
Ben Sweet & Associates has at least 61 recorded sales in the Beltline since 2002 — 42 helping buyers, 16 for sellers, 3 for clients who both bought and sold — plus 29 verified client reviews from Beltline clients (team transaction records and review platforms, as of October 2026).
If you both want a neutral starting point before any lawyer meetings, my free home evaluation lays out the comparable sales behind the number, and the Calgary home prices by community page shows where your area sits right now.
