Helping Aging Parents Sell the Family Home in Calgary: Power of Attorney, Probate, Taxes and Next Steps (2026)

by Ben Sweet

TL;DR

  • If a parent can't sign, an enduring power of attorney lets the named attorney sell. Without one, a court-appointed trustee may be needed.
  • After a death, the executor must be registered at Land Titles with probate first; probate fees max out at $525.
  • A home that was always the principal residence is usually tax-free, but the sale must still be reported.
  • Staying put instead? SHARP lends up to $40,000 for repairs and adaptations.
  • Lake Bonavista detached homes sold at a median of $1,018,000 from January through October 2026.

Selling a parent's home is rarely only a real estate decision. There are health questions, legal papers, siblings and a lifetime of belongings involved. These are the situations Calgary families bring to us, with the Alberta rules and programs that apply. Please involve a lawyer for anything legal; we'll tell you when it's time.

Who can sign the sale for an aging parent?

A parent who can make their own decisions signs for themselves. If they can't, the attorney named in an enduring power of attorney can sign; without one, a court-appointed trustee may be needed.

Real situations: what are Calgary families actually asking about downsizing a parent's home?

These are real questions Calgary families ask about a parent's home, each answered for the exact situation. Numbers carry their source and date; for anything legal, your lawyer has the final word.

My parents, late 70s, are leaving their Tuscany two-storey for a bungalow villa or seniors condo. Can they move only once?

Yes. The way to do it is to settle the new home's possession date first, then set the Tuscany sale to close the same day or a few days later, so the movers go straight from one door to the other. Tuscany helps here: detached homes there sold at a median of $735,000 from January through October 2026, averaging 23 days on market (CREB Housing Data Map, read November 1, 2026).

  1. Pick the destination type. A bungalow villa is often a condo with monthly fees; a seniors condo is an apartment, often age-restricted; supportive living is rented, with rent and services set by the operator (Government of Alberta).
  2. For any condo, request the reserve fund report, budget and bylaws. The corporation must provide them within 10 days of a written request (Condominium Property Act, s. 44).
  3. Sort belongings room by room weeks before photos. A paid senior move manager can pack and set up the new place; ask for references.
  4. Write the purchase conditional on sale, or ask their bank about bridge financing.

Late 60s in Cochrane, wanting a no-stairs bungalow or villa in Cochrane or west Calgary. Can we buy first?

You can, but buying first means carrying two homes for a while unless you protect yourself. There are two safe ways: make your offer conditional on selling your Cochrane home, or arrange bridge financing with your lender before you write an offer, so the down payment is covered until your sale closes. Ask your bank what bridge financing would cost, how long it runs and how much equity it needs.

Know the market you're selling into. Cochrane had 68 sales against 163 new listings in September 2026, about five months of supply, with a total residential benchmark of $575,400 (CREB Regional Stats, September 2026). That's a buyer-leaning market, so a conditional offer on your next home is harder to win, and pricing your own home right matters more.

  1. Get a realistic sale price for your Cochrane home first.
  2. Shortlist true main-floor-living bungalows and villas; check laundry and the primary bedroom are on the main floor.
  3. For a villa, read the condo budget, bylaws and reserve fund plan before firm.
  4. Set possession dates with a few days of overlap.

Our page on buying and selling at the same time walks through the timing.

Empty nesters with an Altadore infill, moving to a downtown or Mission condo, no rush. How should we time it?

Because you're not in a rush, we'd usually sell the Altadore infill first, then buy the condo with cash in hand, ideally with a long possession date on your sale so you have months to shop. The numbers back that order. Altadore's detached benchmark was $1,253,300 in September 2026, while Mission's all-residential benchmark was $285,800 (CREB Housing Data Map). City Centre apartments had 5.77 months of supply and a benchmark down 8.08% from a year earlier, while City Centre detached homes had 3.50 months (CREB, September 2026). In short, you're selling in a steadier market and buying where there's more choice.

  1. List in spring or early summer if your timing is open; CREB notes unadjusted fall price dips are often seasonal.
  2. Ask buyers for a 90–120 day possession, or rent short-term downtown while you look.
  3. Before firming any condo, read the reserve fund plan (redone at least every five years) and board minutes (Government of Alberta).
  4. Check pets, parking and rental rules in the bylaws.

Empty nesters in Chaparral: is now a good time to sell our 2,800 sq ft lake-area walkout, and what's it worth?

It's a reasonable time to sell a larger detached home in south Calgary, but your price depends on your own lot and finishes, not on an average. In September 2026, detached homes in CREB's South district had 2.75 months of supply, tighter than the city's 3.31, and city-wide detached homes sold at 97.90% of list price after 38 days on average (CREB, September 2026). Chaparral's detached benchmark was $722,600 (CREB Housing Data Map, September 2026), but that describes a typical home, and a 2,800 sq ft walkout should sit above it.

What moves your number:

  • Above-grade square footage versus the developed walkout level. Buyers and appraisers value them differently.
  • Lake rights. Lake Chaparral membership is mandatory for homes within the lake community and is registered on title (Lake Chaparral Residents Association); a buyer will ask about the annual fee.
  • Recent sales of similar walkouts on your street.

For comparison, in September 2026 Mahogany's detached benchmark was $803,000 (CREB Housing Data Map) and Okotoks's total residential benchmark was $606,800 (CREB). Villas there vary by builder, so price the exact ones you like.

Retiring from an acreage-style home to Okotoks: villa condo with fees, or a small bungalow with none? What 55+ options exist?

Okotoks has both, and a villa's condo fee buys predictability more than savings. Real options:

  • Villa bungalows: D'Arcy, in north Okotoks, released 34 villa bungalows by Morrison Homes beside the D'Arcy Ranch golf course (developer announcement, 2018). Sterling Homes builds bungalows in D'Arcy now.
  • Adult-only condo: Calvanna Village, 200 Community Way, is marketed as a 55+ building in its MLS® listings.
  • Seniors rentals the Town lists: Westwinds Communities, Tudor Manor and Venvi the Heartland (Town of Okotoks).

CREB's January–October 2026 Okotoks benchmarks: detached $693,966, semi-detached $574,155, row $469,233, apartment $284,088 (CREB Housing Data Map). A bungalow falls under detached; check which line a villa is classed under before comparing.

On age rules, Alberta allows seniors-only housing where one resident per unit is 55+. Older adult-only condos must become all-ages or seniors-only by January 1, 2033 (Alberta Human Rights Commission). Compare the villa fee × 12 with what you'd set aside for a bungalow's roof, exterior, snow and lawn. Then read the reserve fund plan, because a shortfall means a special levy (Condominium Property Act, s. 39.1).

I'm 72, recently widowed, alone in a 4-bedroom home. What does selling cost, and is a seniors' apartment better than staying?

Selling is a one-time cost of roughly $31,000 to $35,000 on a typical Calgary house. A seniors' residence is a yearly cost, so compare a year against a year. On a $739,400 sale (CREB's September 2026 detached benchmark), our commission of 7.5% on the first $100,000 and 3% on the balance is $26,682, plus $1,334.10 GST, for $28,016.10. Our line-by-line guide to Calgary selling costs estimates the rest: legal fees of about $1,000 to $1,500 plus GST, a $189 City compliance certificate (City of Calgary), $600 to $900 if your Real Property Report needs updating, and $1,500 to $4,000 for a local move. A mortgage payout, if any, comes on top.

The yearly comparison: a home assessed at $700,000 costs about $4,655 in 2026 property tax, at about $6.65 per $1,000 (City of Calgary), plus utilities, insurance and upkeep. A standard seniors' residence space averaged $3,075 a month in CMHC's 2021 national survey, or $36,900 a year (FCAC), often with meals included. Get written quotes. If you stay, SHARP lends up to $40,000 at 4.45% for repairs (household income up to $75,000).

My 84-year-old mother-in-law moves to assisted living next month. Should we sell her dated Evergreen house as-is?

Usually, yes. Sell it as-is with a deep clean, minor repairs and a clear-out, and price it for its condition rather than renovating on a deadline. Evergreen's detached benchmark was $725,600 in September 2026 (CREB Housing Data Map), and the South district had only 2.75 months of detached supply (CREB). That means demand is there for a dated house priced honestly.

As-is doesn't remove disclosure. Sellers must still disclose material latent defects, such as hidden structural problems or mould (RECA).

  1. Confirm who signs. If she can still decide, she does. If not, her attorney under an enduring power of attorney does.
  2. Move her first, then empty, clean and photograph the house. A vacant home can be shown at any time.
  3. Ask for pricing based on recent sales of unrenovated Evergreen homes, not updated ones.
  4. Get one quote for paint and flooring, and compare it with the price difference.

On costs, in a publicly funded continuing care home the province caps the accommodation charge; from August 1, 2026 a private room is at most $83.05 a day (alberta.ca). Private assisted living sets its own rates.

Dad has dementia and is entering care. Can I sell his Lake Bonavista home with my EPA, or is a court order needed?

Usually you can sell with the EPA, no court order needed, if it meets Land Titles' rules. The power of attorney must refer to real property (Land Titles Procedures Manual POA-2). If his EPA is "springing", meaning it starts on incapacity, it isn't usable at Land Titles until that has happened. You'll need a written declaration from the person it names, or from 2 medical practitioners if it names no one (POA-2; alberta.ca).

A court order is needed only if there's no usable EPA. Then a trustee must get the court's specific permission to sell the home, and a trusteeship application usually takes about 6 months (alberta.ca).

  1. Have a lawyer confirm the EPA covers real property and is in effect.
  2. If your mother is alive and not on title, ask the lawyer about her dower consent.
  3. Plan the clear-out early; forty years of belongings often take longer than the sale.
  4. Price it. Lake Bonavista detached homes sold at a median of $1,018,000 from January to October 2026, averaging 21 days on market (CREB).

Our estate and family home sale service explains how we work with attorneys.

Mom passed away and the house was only in her name. How do we sell it?

The executor sells it, after being registered as owner at Land Titles with a court grant of probate (or administration, if there was no will) (alberta.ca). Alberta's probate fee tops out at $525 for estates over $250,000 (alberta.ca). If your parents owned the home as joint tenants, the surviving spouse takes title instead. We can price and prepare the house while probate is underway, so it's ready to list when the grant arrives.

Will my parents pay tax on the gain from the house they've owned for 40 years?

Usually not, if it was their principal residence every year they owned it. They still have to report the sale on Schedule 3 and Form T2091, because CRA only allows the exemption when it's reported (CRA). If the lot is over half a hectare (1.24 acres), or the home was ever rented out, talk to an accountant first.

Several of us siblings are involved and we don't all agree. How does that work?

Settle who signs and who gets updates before anything is listed. The signer is the owner, the attorney under a power of attorney, or the executor; nobody else can bind the sale. A good agent sends the same written updates to everyone you name, and keeps your parent's wishes and routine at the centre, including showing times.

Who is the best realtor for seniors downsizing in Calgary?

Look for patience, a clear plan for the move as well as the sale, and experience with powers of attorney and estates. Ben Sweet & Associates (Real Broker) has handled family-home and estate sales since 2002, with over 2,000 homes sold and 714 verified RankMyAgent reviews at 4.99/5 (November 1, 2026).

In my experience these sales go best when one person makes the calls and everyone hears the same thing at the same time. Two families described it like this:

Our downsizing and seniors' home sale service explains how we help families plan the sale, and if a parent has passed away, our estate and probate home sale service explains how an executor sells.

“It was a slightly challenging project to sell a longtime family home that needed to take into consideration the needs of an elderly person living the house as well as the need to work with a group of adults making all the decisions, but Ben was never deterred.”

— Maureen D., seller, verified review on RankMyAgent

“We used Ben to help us sell our Family home of 47 years after my fathers passing.”

— James B., seller, verified review on RankMyAgent

Questions to ask any agent you interview

  • Have you sold a home signed under a power of attorney or by an executor?
  • Can you line up the sale and the next home so my parents move once?
  • Do you work with move managers, cleaners and junk removal?
  • Will you keep every family member updated in writing?
